You
should check your credit card agreement to make sure it complies with
the requirements of the 1974 Consumer Credit Act. Because if it doesn't,
you don't have to pay it, and it's as simple as that!
Of
course, we don't advocate taking out credit cards and not paying the
money back (after April 2007 that would not be possible anyway) but
there is a good chance that it will not be enforeable because the original
credit agreement, or contract, did not specify the prescribed terms.
That is why you should check your credit card agreement to see if it
falls foul of the law.
Another
possibility is that your credit card account may be in the hands of
a debt collection agency (DCA) or debt purchasing company (DPC). If
this is the case, and if the company has bought the delinquent debt
outright (and is not just trying to recover the debt on behalf of the
original lender, such as a bank) then the chances are that the original
credit agreement and supporting documentation will have been lost in
the process.
If
the debt collecting company or debt purchasing company cannot produce
a true copy of the original credit agreement then that, too, is an infringement
of the law, and the debt is unenforceable.
